An act relating to assault weapons and large-capacity magazines; creating s. 790.301, F.S.; providing definitions; prohibiting the sale or transfer of an assault weapon or large-capacity ammunition magazine; providing exceptions; providing criminal penalties; prohibiting possession of an assault weapon or large capacity magazine; providing exceptions; providing criminal penalties; requiring certificates of possession for assault weapons or large-capacity ammunition magazines lawfully possessed before a pecified date; providing requirements for certificates; specifying the form of certificates; providing requirements for an applicant who fails to qualify for such a certificate; limiting transfers of assault weapons or large-capacity ammunition magazines represented by such certificates; providing conditions for continued possession of such weapons or large capacity ammunition magazines; requiring certificates of transfer for transfers of assault weapons or large capacity magazines; providing for relinquishment of assault weapons or large-capacity magazines; providing requirements for transportation of assault weapons or large-capacity magazines; providing criminal penalties; specifying circumstances in which the manufacture or transportation of assault weapons or large-capacity magazines is not prohibited; exempting permanently inoperable firearms from provisions; amending s. 775.087, F.S.; providing enhanced criminal penalties for certain offenses when committed with an assault weapon or large-capacity magazine; providing severability; providing an effective date.
Amends the Criminal Code of 2012. Makes it unlawful for any person to knowingly possess an assault weapon 300 days after the effective date of the amendatory Act, except possession of weapons registered with the Department of State Police in the time provided. Provides exemptions and penalties. Effective immediately.

Create new sections of KRS Chapter 237 to specify definitions for "assault weapons," "large-capacity ammunition-feeding devices," "bump stocks," and "ammunition sellers"; require background checks for private firearms sales; require reporting to law enforcement of firearm and ammunition thefts and losses; require the safe storage of firearms; and to prohibit the manufacture, sale, or transfer of a bump stock; amend KRS 395.250 to require an estate's inventory to list each firearm; amend KRS 403.735 to require judges, when issuing an order of protection, to consider whether a person against whom the order is entered should be prohibited from possessing an firearm; amend KRS 504.030 to require judges in criminal cases where a person is found guilty by reason of insanity to demand the surrender of the defendant's firearms; amend KRS 237.104 to conform; amend KRS 506.080 to specify that the offense of facilitation includes assistance in providing firearms; amend KRS 508.020 to include physical injury to a minor by virtue of the intentional discharge of a firearm within the offense of assault in the second degree; create a new section of KRS Chapter 527 to create the offense of criminal purchase or disposal of a weapon; amend KRS 527.040 to require that the sentence for a felon in possession of a firearm be served subsequent to any other felony sentence; amend KRS 527.070 to include post secondary education facilities within the existing ban on firearms in schools; amend KRS 532.030 to require the judge pronouncing a defendant guilty but mentally ill to demand the surrender of the person's firearms; create a new section of KRS Chapter 237 to require the State Police to promulgate administrative regulations relating to the licensing of persons to possess firearms and assault weapons, the registration of firearms and assault weapons, and the logging of firearms and ammunition sales effective January 1, 2020; amend KRS 532.025 to conform; amend KRS 237.115 to conform; repeal KRS 65.870
TO AMEND SECTION 16-23-210, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO DEFINITIONS FOR PURPOSES OF THE ARTICLE, SO AS TO DEFINE THE TERMS "ASSAULT WEAPON" AND "HIGH-CAPACITY MAGAZINES"; TO AMEND SECTIONS 16-23-220, 16-23-230, AND 16-23-240, RELATING TO THE UNLAWFUL TRANSPORTATION, STORING, KEEPING, OR POSSESSING; AND SALE, RENTAL, OR GIVING AWAY OF MACHINE GUNS, MILITARY FIREARMS, SAWED-OFF SHOTGUNS OR RIFLES, RESPECTIVELY, SO AS TO INCLUDE ASSAULT WEAPONS AND HIGH-CAPACITY MAGAZINES IN THE LIST OF ITEMS BANNED BY THE PROVISIONS OF THE STATUTES; AND BY ADDING SECTION 16-23-540 SO AS TO PROHIBIT THE POSSESSION, DISTRIBUTION, OR MANUFACTURE OF A DEVICE, PART, COMPONENT, ATTACHMENT, OR ACCESSORY INTENDED TO ACCELERATE THE RATE OF FIRE OF A SEMIAUTOMATIC FIREARM, INCLUDING A DEVICE COMMONLY KNOWN AS A BUMP STOCK OR TRIGGER CRANK, TO PROVIDE A PENALTY FOR A VIOLATION OF THIS SECTION AND TO ALLOW EXCEPTIONS UNDER CERTAIN CIRCUMSTANCES.
