Washington HB 1319 - Local Control
An Act amending Titles 18 (Crimes and Offenses) and 53 (Municipalities) of the Pennsylvania Consolidated Statutes, in firearms and other dangerous articles, further providing for limitation on the regulation of firearms and ammunition; and, in home rule and optional plan government, further providing for limitation on municipal powers.
Relating to the regulation of firearms, air guns, knives, ammunition, or firearm or air gun supplies or accessories by a county or municipality.
Authorizes city, county, metropolitan service district or port operating certain commercial airports to adopt ordinance regulating or prohibiting possession of firearms in public buildings by concealed handgun licensees. Authorizes school district, college or university to adopt policy regulating or prohibiting possession of firearms in public buildings by concealed handgun licensees. Punishes possession of firearm in violation of ordinance or policy by maximum of five years' imprisonment, $125,000 fine, or both. Modifies definition of public building, for purposes of crime of possession of weapon in public building, to include certain airport areas, buildings owned or controlled by state or city agency and real property owned by college or university. Punishes violation by maximum of five years' imprisonment, $125,000 fine, or both. Exempts from prohibition person possessing firearm in certain airport areas when firearm is unloaded and in locked container for purposes of transporting firearm as checked baggage.
Gun Violence Prevention Act
Prohibit certain local ordinances regarding firearms.
The legislature finds that public engagement and participation in government is an important component of our democratic system and that government is more effective when it gathers and considers public input when making policy decisions. The legislature further finds that in order to encourage public participation, the residents need to feel comfortable in exercising their rights to associate and speak freely their views on important and contentious public policy issues. The legislature further finds that the open carrying of firearms in public meetings of local governmental entities can result in intimidation and have a chilling effect on the willingness of residents to engage in public participation. The legislature intends to provide local jurisdictions with the authority to regulate the open carrying of firearms in public meetings of local governmental entities to foster an environment where all persons feel comfortable to engage and provide input in the governmental policy-making process.
Localities; regulation of firearms in government buildings. Allows localities and authorized agents of such localities to regulate the possession of firearms, ammunition, or components or combination thereof in, or the carrying of such items into, any building owned or used by such locality for governmental purposes. The bill also removes the prohibition against a locality regulating the purchase, transfer, ownership, carrying, storage, or transporting of such items. Current law prohibits localities from adopting or enforcing any ordinance, resolution, or motion regarding firearms, ammunition, or components or combination thereof, except workplace rules relating to terms and conditions of employment of the workforce or unless such ordinance, resolution, or motion is expressly authorized by statute.
AN ACT to amend the criminal procedure law, the family court act, the domestic relations law, the general business law, the judiciary law, the mental hygiene law, the penal law and the surrogate's court procedure act, in relation to limiting the application of certain provisions of law relating to firearms to the counties of Kings, Queens, Richmond, New York and Bronx; and to repeal section 400.02 of the penal law relating to the statewide license and record database
This bill allows a school district, school administrative unit, or chartered public school to adopt and enforce a policy regulating firearms, firearms components, ammunition, firearms supplies, or knives within its jurisdiction.
